Collection, Use and Disclosure of Information

Collection: We collect your personal information where you provide it to us voluntarily, with your consent, or otherwise as permitted or required by law. We may collect your personal information when you:

JJVC and its agents and representatives may collect personal information such as:

1. personal and business contact information, such as name, title, address, telephone number and e-mail address;
2. information about eye care professionals that our sales representatives may collect during their visits with the eye care professionals with whom they deal, for instance title, qualifications, areas of practice or specialization, their questions or comments about our products, size of their practice, hours they work, and related information relevant to maintaining and managing our relationship with the eye care professionals;
3. names and other contact details of individuals who use our products and their eye care professionals and, in certain circumstances, sensitive health information, and patient medical history, which may be collected in circumstances where we have received a product complaint or report of a problem, where we are providing patient-specific assistance with respect to the use of our products, or where we are assisting in or co-ordinating product recalls;
4. inquiries or comments about our products that are provided by individuals who contact us;
5. information from individuals visiting our premises such as their name and the name of the organization for which they work or which they represent. We do also post video cameras in public-access areas on our premises.

Some areas of our web sites may ask you to submit personal information in order for you to benefit from the specified features such as a reminder service or to participate in a particular activity such as chatrooms, bulletin boards, surveys, rebates or other promotions. You will be informed what information is required and what information is optional.

Use: We will collect and use personal information in order to:

2. provide our products and services and manage our business;
3. establish and maintain our relationship with eye care professionals and other individuals with whom we have contact in the course of our business;
4. provide assistance and advice to eye care professionals with respect to our products;

6. assist in or co-ordinate product recalls;
7. administer contests, promotions, surveys and web site chat rooms and bulletin boards;
8. develop and improve our products;
9. provide you with product-related information;
10. provide eye care professionals with information about product offers and services;
11. send rebates to patients who have sent in coupons for redemption;
12. send eye appointment reminders and reminders to change contact lenses, purchase new lenses and schedule eye exams to patients who have asked to receive such reminders;
13. ensure the security and integrity of our web sites and the web sites of Johnson & Johnson Canadian Affiliates, and our operations;
14. test and analyze our products for efficacy and safety;
15. enable us to act responsibly in the event of a crisis or emergency and to enhance workplace security;
16. develop and implement brand and consumer marketing programs and send educational materials -that specifically tailor consumer offers or communications to your specific needs based on personal information that you have provided to us that indicates such things as your product or purchasing preferences or requirements;
17. develop and implement brand and marketing programs and send educational materials that specifically tailor offers or communications to eye care professionals based on personal information that you have provided to us that indicates such things as the nature of your practice and your product or purchasing preferences or requirements;
18. comply with applicable regulatory requirements;
19. evaluate resumes or other personal information submitted to us in connection with employment possibilities, to assess whether to offer the employment candidate a position at JJVC. For candidates who are not offered or do not accept a position, we may retain their information in the event that an appropriate position becomes available or that they re-apply to JJVC.

We may also use your personal information for other purposes that are disclosed at the time of collection, or as otherwise permitted or required by law.

Service Providers: Your personal information may be transferred to agents or service providers (which may include affiliates of JJVC acting in this capacity) that perform services on our behalf, for instance IT service providers, or otherwise to collect, use, disclose, store or process personal information on our behalf for the purposes described in this Privacy Policy. Some of these service providers or affiliates may be located outside of Canada, including in the United States, and your personal information may be collected, used, disclosed, stored and processed in the United States or elsewhere outside of Canada for the purposes described in this Privacy Policy. Reasonable contractual or other measures we may take to protect your personal information while processed or handled by these service providers are subject to legal requirements in Canada, the United States and other foreign countries applicable to our affiliates, agents and service providers, for example lawful requirements to disclose personal information to government authorities in those countries.

Disclosure:

We may disclose personal information when required in order to meet legal or ethical requirements. In most cases involving personal health information, we will obtain more detailed consent from all patients involved.

We disclose product complaints or reported problems to our affiliates in the U.S. for evaluation and assessment there.

Your personal information may, depending upon the consent you have provided (see the section on "Consent" below), be stored in the Johnson & Johnson Canada Consumer Database. Johnson & Johnson Canadian Affiliates will have access to your personal information that is stored in the Johnson & Johnson Canada Consumer Database in accordance with the consent you have provided. Johnson & Johnson Canadian Affiliates are JJVC, LifeScan Canada Ltd., Johnson & Johnson Inc., and Johnson & Johnson Medical Products, a division of Johnson & Johnson, Inc. Johnson & Johnson Canadian Affiliates are obligated to treat your personal information in accordance with this Privacy Policy.

Your personal information may be used by JJVC and disclosed to parties connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of JJVC's business or assets, including for the purpose of permitting such parties to determine whether to proceed or continue with such transaction or business relationship, to fulfill reporting or audit requirements or the use and disclosure by those parties for substantially the same purposes as described in this policy.

We also may disclose your personal information to third parties, located in Canada and/or any other country where required or permitted by applicable laws, court orders, or government regulations.

JJVC does not disclose your personal information other than as described in this policy or otherwise with your consent, unless permitted or required by law.

Consent

Consent to the collection, use and disclosure of your personal information may be given in various ways. Consent can be express (express consent may be oral, in writing or electronic), implied (such as when you provide your name and address in order for us to send you products or information you have requested) and may be given by your authorized representative (such as a legal guardian or a person having a power of attorney). Generally, by providing us with your personal information, we will assume that you consent to our collection, use and disclosure of such information as described in this Privacy Policy. However, you may be asked to "opt in" or "opt out":

Where this "opt out" option is available, your consent to our collection, use and disclosure of your personal information will be implied unless you "opt out".

When you wish to participate in a promotion, contest, or survey, you will not be required, as a condition of your participation, to provide more personal information than is necessary in order for us administer the promotion, contest or survey and to deliver any products you may be entitled to receive. However, you may be provided with the option of providing additional personal information. You may, for example, choose to provide additional personal information by completing a questionnaire on a contest ballot relating to your use of our products, in which case we may then use that information to assist us in developing, improving, and selling our products.

There are instances where we may collect, use or disclose your personal information without your consent, for example, to collect a debt you owe us or to comply with a court order or subpoena.

About Teenagers and Children

Children under the age of 13: We do not intend to collect personal information from individuals under the age of 13. We will not knowingly collect information from Johnson & Johnson Canadian Affiliates' web site visitors in this age group. If a child under 13 has provided us with personal information, we ask that a parent or guardian of the child contact us to request that this information be deleted from our records. We will use reasonable efforts to delete the child's information from our existing files. We encourage parents to talk to their children about their use of the Internet and the information they disclose to web sites or otherwise.

Teenagers 16 and Over: We will not knowingly collect, use and disclose the contact and other personal information of a teenager 16 and older without obtaining the teenager's express consent.

We will use reasonable efforts to delete all contact and other personal information obtained from a teenager if we are notified by a parent or guardian that they wish to withdraw consent for the collection of a teenager's information.

Active Information Collection: Like many web sites, the Johnson & Johnson Canadian Affiliates' web sites actively collect information from its visitors both by asking you specific questions and by permitting you to communicate directly with us via e-mail and/or feedback forms.
